1. Who we are

This online store at shop.lebere.eu (the “Store”) is operated by Lebere, Leja Resnik s.p., Hočevarjev trg 9, 8270 Krško, Slovenia, tax number 55840493 (“LEBERÉ”, “we”, “us”). Contact: info@lebere.eu, +386 71 988851.

2. Scope

These Terms apply to all purchases made in the Store. They do not apply to color analysis appointments booked through www.lebere.eu, which are subject to the booking conditions stated there. By placing an order you confirm that you have read these Terms, our Refund Policy and our Privacy Policy. If you are a consumer, nothing in these Terms limits the rights you have under mandatory consumer protection law.

3. Products

The Store offers:

• Personal Seasonal Color Guide – a physical transparent card, shipped to your address.
• LEBERÉ Personal Color Palette App – digital content: a personal access code to your seasonal palette in a web application (PWA), delivered by email.
• LEBERÉ gift cards – vouchers redeemable for LEBERÉ services, under the conditions and validity period stated on the voucher.

We take care to display colors as accurately as possible. Colors on screen can differ from the physical product depending on your device and display settings.

4. Prices and payment

All prices are in euros (EUR). Any applicable taxes and shipping costs are shown before you complete your order. Payment is processed through Shopify and the payment methods offered at checkout. We may correct obvious pricing errors; if an error affects your order, we will contact you before processing it and you may cancel free of charge.

5. Order and contract

Your order is an offer to buy. The contract is concluded when we send you the order confirmation by email. We may decline an order, for example if a product is unavailable; in that case any payment is refunded in full.

6. Delivery

Physical products are shipped to the address you provide. Delivery times and costs are shown at checkout. Risk of loss passes to you when you, or a person you designate, receive the goods.

Digital content (the Palette App access code) is sent to the email address given in your order after payment is confirmed. Please check your spam folder. If you have not received it within 24 hours, contact us.

7. Right of withdrawal

Consumers in the EU may withdraw from a purchase within 14 days, as described in our Refund Policy. For digital content, the right of withdrawal ends once delivery has started, if you gave your express consent to immediate delivery and acknowledged that you thereby lose your right of withdrawal.

8. Use of the Palette App

Your access code is personal. We grant you a non-exclusive, non-transferable right to use the app and your palette for personal, non-commercial purposes. You may not resell, share publicly or copy the content. All texts, palettes, designs and images in the Store and the app are the property of LEBERÉ or its licensors.

9. Warranty

You are entitled to the statutory warranty for lack of conformity under Slovenian and EU consumer law. If a product is defective or not as described, contact us at info@lebere.eu.

10. Liability

We are liable in accordance with applicable law. We are not liable for damage caused by incorrect use of the products or for temporary unavailability of the app due to maintenance or circumstances beyond our control. This does not limit liability that cannot be excluded by law, including liability for intent, gross negligence or personal injury.

11. Complaints and disputes

Please send any complaint to info@lebere.eu. We confirm receipt within 5 working days and try to resolve it within 8 working days. We do not recognize any provider of out-of-court consumer dispute resolution as competent for disputes with our customers.

12. Governing law

These Terms are governed by the law of the Republic of Slovenia. If you are a consumer, you also keep the protection of mandatory provisions of the law of the country where you live. Disputes are decided by the competent court in Slovenia, unless mandatory law provides otherwise for consumers.

13. Changes

We may update these Terms. The version published at the time of your order applies to that order.
